    The Foundation for Sustainable Energy (FNEZ) has submitted amendments to the Minister of Maritime Economy and Inland Waterways and the Minister of Development’s draft version of a regulation on the required scope of the spatial development plans of internal waters, territorial sea, and exclusive economic zone.

    In FNEZ’s opinion the document may be an important step towards the implementation of plans of the Polish internal waters, territorial sea, and exclusive economic zone. To make this happen, it is necessary to amend it in a way that will enable usage of the energy potential of Polish marine areas.

    FNEZ has submitted several comments, including those of a general and detailed nature. They cover, inter alia:

    • establishing rules of conduct in case of a dispute situation,
    • exploiting the potential of renewable sources on the sea,
    • developing solutions of regulations concerning the basic and acceptable functions for individual water bodies,
    • correlating the terms used in the regulation with existing definitions established under the Polish Act on Energy Law,
    • incorporating the strategic documents for the energy sector such as the state energy policy in the planning process.

    Amendments proposed by FNEZ adjust the draft version of the regulation to the conditions of the industry’s development and combine them with legal solutions established under the Polish Act on Maritime Areas.
